2. Eligibility and Account Registration

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase a Paid Plan.

• You must provide accurate, current, and complete information when registering and purchasing a Subscription, and keep that information up to date.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• ARK may refuse, suspend, or terminate any Subscription at its discretion, including where information provided is false, incomplete, or where these Terms have been breached.

3. Billing and Payment

 

Payment processing. Payments for Paid Plans are processed through the Site's third-party payment provider. By subscribing, you authorize ARK and its payment processor to charge your chosen payment method for the applicable subscription fee.

 

Billing cycle. At checkout, you may choose to pay for a Paid Plan on a monthly or annual basis. Your Subscription is billed in advance for the selected billing cycle, starting on the date of purchase, and automatically renews for successive periods of the same length (one month or one year, as applicable) until cancelled in accordance with Section 5.

 

Annual billing. Annual Subscriptions are charged as a single up-front payment equal to eleven (11) times the monthly price — i.e., one month free compared to paying monthly — covering twelve (12) months of membership: USD 550/year for the Entrepreneur plan and USD 1,650/year for the Impact Partner plan.

 

Currency and taxes. All fees are quoted in United States Dollars (USD) and are exclusive of any applicable taxes, duties, or bank/currency-conversion charges, which are your responsibility.

 

Failed payments. If a payment cannot be processed, ARK may retry the charge, suspend access to Paid Plan benefits, or downgrade your account to the Community plan until payment is successfully made.

4. Price Changes

 

ARK may change Subscription pricing from time to time. Any price change will be communicated to Members with reasonable advance notice and will take effect from the next billing cycle following such notice. Continuing a Subscription after a price change takes effect constitutes acceptance of the new price.

5. Cancellation

 

Cancel anytime. You may cancel a Paid Plan at any time via your account settings on the Site ("My Subscriptions") or by contacting ARK at arkentrepreneurship@proton.me.

 

Effective date. Cancellation takes effect at the end of the then-current billing cycle — that is, the end of the current monthly period for monthly Subscriptions, or the end of the current 12-month period for annual Subscriptions. You will retain access to your Paid Plan's benefits until that date, after which your account will revert to the free Community plan unless you resubscribe.

 

No partial-period refunds. Because cancellation stops future billing rather than ending your current paid period early, no refund or credit is issued for the remainder of a monthly or annual billing cycle already paid for.

 

 

6. Refund Policy

 

All Subscription fees are non-refundable, except where required by applicable Icelandic consumer protection law. This includes, without limitation:

• Fees already charged for the current billing cycle at the time of cancellation;

• Partial months of use; and

• Non-use of the benefits associated with a Paid Plan during a billing cycle.

 

If you believe you were charged in error, contact ARK at arkentrepreneurship@proton.me within 14 days of the charge.

 

 

7. Membership Benefits

 

Benefits associated with each plan (such as newsletters, event invitations, directory listings, toolbox access, member discounts, promotional opportunities, brand partnership, and sponsorship visibility) are described on the Site at the time of purchase. ARK will use reasonable efforts to provide these benefits but does not guarantee specific outcomes (such as introductions, investment, media coverage, or event attendance figures) arising from membership.

8. Member Conduct

 

By subscribing, you agree not to:

• Use your membership for any unlawful purpose or in violation of these Terms;

• Misrepresent your affiliation with ARK or use ARK's name, logo, or "Founding Partner"/"Brand Partner" designations without authorization;

• Share your account or Subscription benefits with third parties who are not covered by your plan; or

• Engage in conduct that ARK reasonably considers harmful to its community, reputation, or mission.

 

ARK reserves the right to suspend or terminate a Subscription, without refund of the current billing cycle, for breach of this Section.

 

 

9. Changes to Plans and Terms

 

ARK may modify, rename, discontinue, or change the features and benefits of any Subscription plan, and may amend these Terms, at any time. Material changes will be posted on the Site or communicated to Members by email with reasonable notice before taking effect. Continued use of a Subscription after changes take effect constitutes acceptance of the revised Terms.

 

 

10. Nonprofit Status and Use of Funds

 

ARK is a nonprofit association. Subscription fees are used to support ARK's mission and operations, including community programs, events, and international partnership activities. Subscription fees are payments for membership benefits and are not charitable donations unless separately designated as such through ARK's donation channel.

 

 

11. Limitation of Liability

 

To the maximum extent permitted by applicable law, ARK's total liability arising out of or relating to a Subscription shall not exceed the total fees paid by you to ARK in the twelve (12) months preceding the claim. ARK shall not be liable for indirect, incidental, special, or consequential damages, including loss of business opportunity, arising from your Subscription or use of the Site.

 

 

12. Termination by ARK

 

ARK may suspend or terminate your Subscription with notice if: (a) you breach these Terms; (b) payment cannot be collected after reasonable attempts; or (c) ARK discontinues the relevant plan or ceases operations. Where ARK terminates a Subscription other than for your breach, ARK will not charge for any subsequent billing cycle.

 

 

13. Governing Law and Disputes

 

These Terms are governed by the laws of Iceland, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or a Subscription shall be subject to the exclusive jurisdiction of the competent courts of Iceland, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
